Terms of use
Please read these terms carefully before using Malek services.
By confirming and electronically signing this document, the applicant for Malek platform user services (hereinafter the “User”), being of sound mind and body, with full consent and free will, without any coercion, compulsion or duress and without any condition, declares their agreement with the terms set out below to Zanjireh Zarreh Malek Company (Private Joint Stock) (hereinafter the “Platform”), registration no. 449323, national ID 1400386953, located at No. 14, 1st floor, 5th Alley, Mir Emad St., Andisheh, Abbasabad, Tehran, postal code 1587943513:
General terms and conditions
Registering and signing in to the Platform constitutes the User's awareness and acceptance of all of the Platform's terms and conditions.
The User has the legal capacity and competence required to receive the Platform’s services. If a lack of capacity or competence is established and proven — such as being barred from transactions, legal incapacity, bankruptcy, or a financial judgment issued by the courts or by registration offices — liability for any damage caused to the Platform and to other partners or related parties rests with the User.
Merely creating a user account and accepting these terms does not complete registration on the Platform; the User must complete the remaining account steps, including identity verification, submitting information and other requirements. If the required documents are incomplete, the Platform may prevent the User’s access by restricting, suspending or deleting the user account.
The User declares that the information and documents submitted are accurate and true, and all consequences of proving otherwise, such as forgery or a mismatch between the declared information and reality, rest solely with the User.
The User may create only one user account on the Platform. Accordingly, the consequences of creating more than one account — such as deletion of the account, freezing of allocated credit, or any other restriction or prohibition on the Platform — rest with the User.
If, for any reason, an amount or credit exceeding the User’s entitlement is deposited to the User’s bank account, the User grants the Platform the necessary legal permission and authority to remove and recover the deposited credit or funds.
The place of acceptance of this document, the place where the Platform’s user system is located and operates, and the place of performance of the obligations related to this agreement is the city of Tehran.
The Platform’s place of business is the city of Tehran, which, pursuant to paragraph (a) of Article 29 of the Electronic Commerce Act ratified 1382/10/17 SH, as amended, is deemed the location of the information system and the place where data messages of the originator and the addressee are sent and received.
The User uses their account personally and does not make it available to third parties. Safeguarding the username and password is the User’s responsibility, and liability for the actions of third parties who access the account also rests with the User.
Whenever performing all or part of the system’s user process becomes impossible or is delayed due to an irresistible and unforeseeable external cause (force majeure), the Platform is not liable for damages arising from non-performance or delayed performance for as long as those conditions persist.
The Platform’s website is www.malek.ir. The Platform communicates with users only through this website, the support phone numbers listed on it, or the SMS short code 9982004344. The Platform does not endorse any online correspondence, call or SMS through channels other than these official addresses and bears no responsibility for the content of other SMS short codes or phone numbers.
The Platform’s operations comply with the laws of the Islamic Republic of Iran, in particular the Electronic Commerce Act ratified 1382/10/17 SH and the Computer Crimes Act ratified 1388/03/05 SH, as amended. When using the website or application, the User must observe all laws and regulations of the Islamic Republic of Iran, including criminal, civil, financial and commercial laws, and specifically the Electronic Commerce Act, the Computer Crimes Act, the Act on the Protection of the Rights of Authors and Composers, the Patents, Industrial Designs and Trademarks Registration Act, the Act on the Protection of the Rights of Computer Software Creators, and all other related laws and regulations. If the laws, regulations and rules governing the Platform’s activity change, the User declares that their continued use of the Platform constitutes acceptance of and commitment to the relevant laws and regulations.
If the User violates these terms, including by disrupting or causing problems in the operation of the website or application or by misusing their access, the Platform has the authority to take appropriate action against the User, including imposing restrictions, suspending the user account or deleting it. The User hereby waives any right to object or complain in this regard.
Intellectual property rights
All financial and moral rights related to the Platform’s website, including but not limited to its design, software, service platform, trade name, logo and trademark, and any other information on this website, belong to the Platform. Accordingly, all rights are reserved for the Platform, and any copying, republishing or commercial use of this website’s content without the Platform’s written permission is prohibited; in the event of a violation, the Platform reserves the right to take any necessary legal action against the violator. Being aware of the Platform’s material and moral rights to the website, the User hereby waives any right to object or complain in this regard.
User privacy policy
The User’s personally identifiable information is kept confidential by the Platform, and the Platform undertakes not to disclose it to third parties unless it is required to provide the data to competent authorities by order of a competent judicial authority or in compliance with an explicit provision of the country’s laws and regulations. In that case, the Platform bears no legal liability for compensation, and the User, by giving their consent, waives any right to object in this regard.
While protecting users’ privacy, the Platform requests information from users in order to provide its services, including identity information (such as first and last name, father’s name, national ID number and date of birth), address and postal code, bank account and card details, and phone number. This information is collected only as necessary and in proportion to purposes such as identity verification, service delivery, resolving system issues and tracking transactions while the system is used. This information is used only by the Platform and is under no circumstances provided to third parties. If needed, the User may submit a written request to the Platform to delete the collected information.
